2. General information on data processing
We process personal data only insofar as this is necessary to provide a functional website, to handle your enquiries and to perform contracts, or where you have given your consent. The legal bases are in particular Art. 6(1)(a) GDPR (consent), Art. 6(1)(b) GDPR (contract and pre-contractual measures), Art. 6(1)(c) GDPR (legal obligation) and Art. 6(1)(f) GDPR (legitimate interests).
We erase personal data as soon as the purpose of storage no longer applies, unless statutory retention obligations (in particular under commercial and tax law) preclude this. In that case, processing is restricted until the retention period expires.
3. Hosting and server log files
This website is hosted by TransIP B.V., Schipholweg 9B, 2316 XB Leiden, the Netherlands. A data processing agreement pursuant to Art. 28 GDPR is in place with the host. The servers are located within the European Union.
When you visit our website, information transmitted by your browser is automatically stored in so-called server log files: IP address, date and time of the request, page accessed, referrer URL, browser used and operating system. This data is necessary for the secure and stable provision of the website (Art. 6(1)(f) GDPR) and is automatically deleted after a short period.
For security reasons, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the padlock symbol in your browser's address bar.
4. Contacting us
If you contact us via the contact form, by email or by telephone, we process the information you provide (e.g. name, email address, telephone number and your message) in order to handle your enquiry. Enquiries submitted via the contact form are stored in our website's database and are also forwarded to us by email. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a contract or is necessary for entering into one, and otherwise Art. 6(1)(f) GDPR (our legitimate interest in responding to enquiries). We delete the data once your enquiry has been fully dealt with and no statutory retention obligations apply.
5. Watch sale enquiries (“Sell your watch”)
Via our watch purchase form, you can send us details of your watch (e.g. manufacturer, model, year, condition, scope of delivery, asking price) as well as photos of the watch, and provide us with your contact details (name, telephone number, email address). We use this data to prepare a no-obligation purchase offer for you and to get in touch with you (Art. 6(1)(b) GDPR). Please upload only photos of the watch and no images showing people or identity documents.
If a purchase takes place, we process the data required for the contract and for the statutory record-keeping and identification obligations. This data is not collected via this website but is recorded separately as part of the purchase and deleted in accordance with the statutory retention periods (Art. 6(1)(b) and (c) GDPR).
6. WhatsApp
Our website contains buttons that allow you to contact us via WhatsApp. These buttons are simple links; no data is transmitted to WhatsApp when you merely visit our website. Only when you click a button is WhatsApp opened, at which point the privacy policy of WhatsApp Ireland Limited (Dublin, Ireland) applies. Data may also be transferred to Meta Platforms, Inc. in the USA; Meta Platforms, Inc. is certified under the EU-US Data Privacy Framework. Communication via WhatsApp is voluntary; the legal basis for our processing of your message is Art. 6(1)(b) or (f) GDPR. Alternatively, you can reach us at any time by telephone or email.
7. Newsletter
If you subscribe to our newsletter, we use your email address exclusively to send you our newsletter with information on offers and new arrivals. The legal basis is your consent (Art. 6(1)(a) GDPR). You may withdraw your consent at any time with effect for the future, e.g. by email to info@eleganzuhren24.com or via the unsubscribe link in the newsletter. Following withdrawal, we will remove your email address from the mailing list.
8. Orders and payment processing
When you buy a watch from us, we process the data required to perform the contract (e.g. name, address, email address, telephone number, order and payment data) on the basis of Art. 6(1)(b) GDPR. For delivery, we pass the necessary data on to the shipping company we have engaged. We retain invoicing and accounting data in accordance with the statutory periods (Art. 6(1)(c) GDPR).
Payment is made by bank transfer or, for handover in person, in cash. If you pay by bank transfer, you will receive our bank details from us; the payment is processed via your bank and ours. We do not use any external payment service providers. For shipping, we transmit your name, delivery address and, where applicable, telephone number to the commissioned shipping company so that the shipment can be delivered and a tracking link can be made available to you.
If you select the option “Also receive the tracking link via WhatsApp” when ordering, we will additionally send you the tracking link via WhatsApp to the telephone number you have provided. In doing so, WhatsApp Ireland Limited (Dublin, Ireland) processes your telephone number and the message; data may be transferred to Meta Platforms, Inc. in the USA, which is certified under the EU-US Data Privacy Framework. The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time with effect for the future, for example by email to info@eleganzuhren24.com. You will always receive the tracking link by email as well.
Where we are obliged to do so under the German Money Laundering Act (GwG), for example for cash payments of €10,000 or more or when buying watches from customers, we record and verify your identity on the basis of an official photo ID and retain this information for the statutory retention period (Art. 6(1)(c) GDPR in conjunction with §§ 8, 11 GwG). When you collect a watch, we check your identity document to protect against misuse (Art. 6(1)(b) and (f) GDPR).
9. Cookies
Our website uses technically necessary cookies, e.g. to store your language setting, the contents of your basket and your cookie choices. These cookies are required for the operation of the website (§ 25(2) TDDDG, Art. 6(1)(f) GDPR).
We use any further cookies and similar technologies, for example to analyse where visitors and enquiries come from, only with your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). You may withdraw your consent at any time with effect for the future.
10. Fonts
The fonts used on this website are stored locally on our server. When you visit the website, no connection is established to servers operated by Google or other font providers.
11. Your rights
You have the right of access to the personal data we hold about you (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), to erasure (Art. 17 GDPR), to restriction of processing (Art. 18 GDPR) and to data portability (Art. 20 GDPR). You may withdraw any consent you have given at any time with effect for the future (Art. 7(3) GDPR). To do so, simply use the contact details given above.
Right to object (Art. 21 GDPR): Where we process data on the basis of Art. 6(1)(f) GDPR, you may object to the processing at any time on grounds relating to your particular situation. If your data is processed for direct marketing purposes, you may object to this at any time.
You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2-4, 40213 Düsseldorf.
