Part A: Sale of watches

§ 1 Scope

1. These General Terms and Conditions (GTC) apply to all contracts for the purchase of watches and jewellery concluded with Eleganz Uhren 24 GmbH via our online shop at eleganzuhren24.com, by email, telephone, WhatsApp or in person.

2. A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (§ 13 BGB). An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into the legal transaction, acts in the exercise of their trade, business or self-employed profession (§ 14 BGB).

3. Deviating terms and conditions of the customer shall not form part of the contract unless we expressly agree to them in text form.

§ 2 Contracting party

§ 3 Offers and conclusion of contract

1. The presentation of the watches in the online shop and in other media does not constitute a legally binding offer, but a non-binding invitation to place an order.

2. By clicking the button “Order with obligation to pay”, the customer submits a binding offer to purchase the goods contained in the basket. Receipt of the order is confirmed automatically by email; this acknowledgement of receipt does not yet constitute acceptance.

3. The contract is concluded when we expressly accept the order by email (order confirmation stating our bank details) or hand over or dispatch the goods. We may accept the order within two working days.

4. Every watch is a unique piece. We are entitled not to accept an order, in particular if
a) the watch has been sold in the meantime or is no longer available,
b) there is an obvious pricing or typographical error in the presentation,
c) the customer's details cannot be verified or there are specific indications of an attempted fraud or abuse.

In these cases, we will refund any payments already made without undue delay and in full.

5. The language of the contract is German. Translations of these GTC are provided for information purposes only.

6. We store the text of the contract. The customer receives the contract data and these GTC in text form with the order confirmation.

§ 4 Prices

1. All prices are final prices in euros. Where a watch is subject to the margin scheme under § 25a UStG, VAT is included in the price but is not shown separately on the invoice. For watches subject to standard taxation, the statutory VAT is included in the price.

2. Shipping costs are stated on the “Shipping & Shipping Costs” page and during the ordering process.

3. For deliveries outside the European Union, customs duties, import VAT and fees may be incurred, which are to be borne by the customer.

§ 5 Payment

1. For orders in the online shop and for shipped orders, payment is made exclusively by bank transfer in advance (payment in advance) to the account of Eleganz Uhren 24 GmbH stated in the order confirmation. For handover in person in Emmerich am Rhein or Arnhem, payment in cash is also possible.

2. The purchase price is payable within seven calendar days of receipt of the order confirmation. The watch is reserved for the customer until this period expires. If payment is not received in time, we are entitled to withdraw from the contract after an appropriate grace period of no more than three working days has expired without result. A grace period is not required if the customer seriously and definitively refuses payment.

3. Payment must be made from an account held in the customer's name. We do not accept payments from third parties. Refunds are made exclusively to the account from which the payment was made.

4. In order to fulfil our statutory obligations under the German Money Laundering Act (GwG), we may require a valid photo ID and information on the source of funds before delivery. For cash payments of €10,000 or more, we are legally obliged to establish and document the customer's identity. We are entitled to withhold delivery until the required documents have been provided. We reserve the right to refuse cash payments if there are indications of money laundering or if statutory cash limits would be exceeded.

§ 6 Reservation

1. Watches may be reserved without a deposit for a maximum of 72 hours. Once this period has expired, the watch will be offered for sale again without further notice.

2. A longer reservation is only possible upon payment of the full purchase price; it is then deemed a purchase under § 3.

3. If, under a purchase contract concluded in person on our business premises, a deposit has been paid and the customer fails to take delivery of the watch despite being set a deadline, we may withdraw from the contract and claim damages. We are entitled to claim a flat rate of 20 % of the purchase price as damages and to set this off against the deposit. The customer remains entitled to prove that no damage or substantially less damage has been incurred; we reserve the right to prove greater damage. Any statutory right of withdrawal remains unaffected.

§ 7 Delivery, shipping and collection

1. Once payment has been received, we generally prepare the watch for dispatch on the same working day.

2. Shipping is fully insured and carried out by specialised shipping service providers (UPS, FedEx or Ferrari Logistics) with shipment tracking. The customer receives a tracking link by email and, if they choose this option when ordering, additionally via WhatsApp. Delivery within Germany and the European Union generally takes place within one to three working days of dispatch.

3. For security reasons, we deliver only against signature and only to the billing address stated in the order or to a delivery address confirmed by us. Delivery to parcel lockers, parcel shops or PO boxes is excluded. The courier may request presentation of an identity document.

4. The customer is asked to inspect the shipment for externally visible damage upon receipt, to report any such damage to the courier and to inform us without undue delay. This does not affect the customer's statutory rights.

5. Collection is possible by prior appointment in Emmerich am Rhein (Germany) or Arnhem (the Netherlands). A valid photo ID must be presented on collection; the watch will only be handed over to the buyer or to a person authorised in writing. We will provide the exact address with the appointment confirmation.

6. If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods passes to the customer only upon handover. If the customer is an entrepreneur, the risk passes upon handover to the carrier.

7. We reserve the right to refuse deliveries to countries subject to sanctions or export restrictions.

§ 8 Retention of title

The goods remain our property until paid for in full.

§ 9 Authenticity, condition and description

1. We sell original watches only. Before sale, every watch is inspected by our watchmakers for authenticity, function and condition and is supplied with a certificate of authenticity issued by Eleganz Uhren 24 GmbH.

2. The condition, year, reference and scope of delivery (e.g. box, papers, invoice) are set out in the respective product description. The product description forms part of the agreed quality. For pre-owned watches, we state, where known, whether the watch has been polished or serviced and whether non-original parts have been fitted.

3. Authenticity guarantee: If an official service centre of the manufacturer or a publicly appointed and sworn expert determines that the watch or a component, contrary to the product description, is not original, we will refund the full purchase price and the proven costs of the appraisal upon return of the watch. This guarantee applies without time limit and in addition to the statutory rights.

§ 10 Right of withdrawal

1. Consumers have a statutory right of withdrawal of 14 days for distance contracts. The details, in particular regarding the start of the withdrawal period and the return of the goods, are set out in our withdrawal policy.

2. During the withdrawal period, the customer may only examine the watch in the way that would also be possible in a shop. The customer must compensate for any loss in value if this is attributable to handling of the goods beyond that, for example by wearing the watch, removing protective films or seals, resizing the bracelet or losing accessories.

3. We ask that the watch be returned complete with box, papers, certificate and accessories, and insured. This is not a precondition for exercising the right of withdrawal.

4. The right of withdrawal does not apply to goods that are made to the customer's specifications or are clearly tailored to the customer's personal needs, for example where an engraving or gemstone setting has been carried out at the customer's request (§ 312g(2) no. 1 BGB). Furthermore, it does not apply to entrepreneurs or to contracts concluded in the simultaneous physical presence of both parties on our business premises.

§ 11 Guarantee

1. In addition to the statutory warranty rights, we grant a guarantee of twelve months from handover on the movement. Any manufacturer's guarantee still in effect remains unaffected.

2. In the event of a guarantee claim, we decide whether the watch is repaired by our watchmakers or, if a repair is not possible, replaced, or the purchase price refunded. Guarantee claims must be notified in text form with a description and photos. We bear the costs of insured shipping in the event of a guarantee claim.

3. The following are excluded from the guarantee: water resistance, crystal, crown and pushers, bracelet and clasp, normal wear and tear, damage caused by drops and impacts, improper handling, and damage caused by the opening, repair or modification of the watch by third parties.

4. The customer's statutory warranty rights are not restricted by this guarantee.

§ 12 Statutory liability for defects

The statutory warranty rights apply (§§ 437 et seq. BGB).

§ 13 Liability

1. We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee assumed.

2. In the event of a slightly negligent breach of a material contractual obligation, our liability is limited to the foreseeable damage typical of the contract. Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. Otherwise, liability for slight negligence is excluded.

Part B: Purchase of watches from customers

§ 14 Enquiry and offer

1. Customers may offer us watches for purchase via our form, by email or WhatsApp. Enquiries and offers are free of charge and without obligation.

2. Our offer is based on the information and photos provided by the customer. It is subject to the inspection of the watch for authenticity, condition and function by our watchmakers. If the watch deviates from the information provided, we may submit a revised offer or refrain from the purchase.

§ 15 Requirements for the purchase

1. The seller must be of legal age and present a valid official photo ID. We are legally obliged to establish and document the seller's identity (GwG).

2. The seller warrants that they are the owner of the watch, are free to dispose of it and that the watch is free from third-party rights, in particular that it has not been stolen, embezzled, pledged or transferred by way of security.

3. We are entitled to check the watch against databases of stolen watches. In the event of a well-founded suspicion of a criminal offence, we may decline the purchase, retain the watch until the matter has been clarified and inform the competent authorities.

4. The purchase is documented in a purchase declaration signed by the seller, which may also be signed digitally.

§ 16 Shipping to us, handover and payment

1. Handover takes place by appointment in Emmerich am Rhein or Arnhem, or by insured shipping. Whether we or the seller bear the costs of insured shipping to us depends on the value of the watch and is communicated in binding form in our offer before shipping. On request, we will provide an insured shipping label.

2. Following successful inspection, the agreed purchase price is paid exclusively by bank transfer to an account held in the seller's name.

3. If no purchase is concluded, we will return the watch to the seller by insured shipping or hand it over by appointment.

4. If the seller is a consumer and the purchase takes place in person, there is no right of withdrawal. Purchase contracts concluded at a distance are governed by the statutory provisions.

Part C: General provisions

§ 17 Data protection

Information on the processing of personal data can be found in our privacy policy.

§ 18 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. We generally respond to enquiries and complaints within 14 days.

§ 19 Applicable law and place of jurisdiction

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.

2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is the registered office of Eleganz Uhren 24 GmbH.

§ 20 Severability clause

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provisions.
